Terms and Conditions

 

terms and conditions 


Please read these terms and conditions before the purchase of any goods, after purchase we will consider these terms and conditions as accepted and understood.

flooring clearance depot reserves the right to add or amend these terms and conditions 

floating floor coverings are not prescribed under the Home Building legislation in NSW but are subject to implied ACL (Australian Consumer Law) statutory warranties provisions. However, they often form part of the residential building contract and are considered to be defective if not installed to the manufacturer’s installation instructions and a breach of implied statutory warranty provisions of ACL.

terms and conditions: Wal Piddington Carpets Pty Ltd ABN: 34059737003 t/as Flooring clearance depot may be referred to as, "we", "our", "us" or "flooring clearance". nothing in these terms and conditions of trade are to be interpreted as excluding, restricting or modifying the consumers right under Australian Consumer Laws. 

Please feel free to discuss any unclear points in these terms and conditions if necessary.


1 Payments

1.1 all payments must be made in full in order to secure products we do not take deposits 

1.2 payments must be made via the specified method in store: bank transfer, cash or credit card.

1.3 all card transactions will incur a 2.2% surcharge 

1.4 flooring clearance depot will not release stock without full payment 

1.5 an additional delivery fee may be added in addition to products depending on location.

1.6 all payments include goods and services tax (GST)

1.7 all quotes and payments are in Australian dollars (AUD)

1.8 All goods ordered for delivery must be paid in full prior to or upon collection of delivery.


2 Delivery

2.1 Upon receipt of order payment, deliveries can take between 2-10 business days.

2.2 flooring clearance depot will make every effort to complete delivery by the estimated date but cannot be held responsible for delays due to circumstances beyond our control or safety, in this case we will complete the delivery as soon as reasonably possible.

2.3 flooring clearance depot drops products TO THE DOOR, our delivery staff retain the right to refuse to bring product inside. (garage is an exception)

2.4 we request an adult be home at time of delivery

2.5 If there is nobody home during the time of delivery our delivery staff will place the goods in an area deemed to be secure.

2.6 It is the customer's responsibility to ensure there is an appropriate storage area which is dry and secure. if the point of delivery is unattended, flooring clearance depot will leave goods in a place deemed safe at the discretion of either flooring clearance depot or the customer and will take no responsibility for damage or theft.

2.7  flooring clearance depot does not accept responsibility for unexpected delays outside of our controls. If there are unexpected delays, we will notify you as soon as possible. Delays will not attract any discounts 

2.8 The delivery time quoted by flooring clearance depot is an estimate only and we cannot be held responsible for delays such as industrial or manufacturing delays.

2.9 Flooring clearance depot does not take any responsibility to damage caused to product after delivery 

2.10 Our delivery team requires ample space and a clear pathway from truck to delivery point. It is the customers responsibility to make sure that this is available before requesting delivery.

2.11 Delivery is conditional upon the customer providing safe, clear, and unrestricted access from the delivery vehicle to the nominated drop-off point. This includes, but is not limited to, adequate space for the truck to park legally and a clear, level pathway free of obstacles such as stairs (unless previously disclosed), steep gradients, narrow access points, vehicles, or other hazards.

2.12 If, upon arrival, the delivery team determines that access is unsafe, obstructed, or insufficient to complete the delivery without risk of injury or damage, the delivery may be aborted at the driver’s discretion. In such circumstances, the delivery will be rescheduled for the next available date, and additional delivery or re-delivery fees may apply.

2.13 It is the customer’s responsibility to ensure suitable access is available at the time of delivery. Failure to do so may result in delays beyond our control.

2.14 flooring clearance depot does not offer delivery on weekends (saturday or sunday)

2.15 Our delivery times are between 9-4pm and will not deliver any earlier if not discussed prior.

2.16 if delivery needs to be delivered on the weekend after being previously discussed with a team member an added weekend delivery cost will be applied


3 installation

3.1 Flooring Clearance Depot does not provide installation services. Any installation of products purchased from Flooring Clearance Depot is arranged independently by the customer.

3.2 flooring clearance depot is not responsible for any damage done to products or any installation errors that have occurred by the customer them selves or any installers.

3.3 Where installers are recommended or referred by Flooring Clearance Depot, such recommendations are provided as a courtesy only. Flooring Clearance Depot does not employ, supervise, or control these installers and accepts no responsibility or liability for their workmanship, conduct, scheduling, pricing, or any issues arising from installation.

3.4 All matters relating to installation, including but not limited to site preparation, product suitability, installation methods, workmanship quality, and compliance with manufacturer guidelines, are the sole responsibility of the installer and the customer. Any defects, damage, or losses resulting from installation must be addressed directly with the installer


4 general terms and conditions 

4.1 Any advice, recommendations or information is given in good faith. Flooring clearance depot accepts no responsibility or liability for any damage or loss suffered by the customer because of reliance on advice, recommendations or information given.

4.2 colour choices are solely that of the customers. Flooring clearance depot does not take responsibility for incorrect colour selections.

4.3 It is the customer's responsibility to acquire a measurement in m2, Flooring clearance depot will not take any responsibility for incorrect measurements or incorrect quantity of product if measurement is incorrect. 

4.4 all quotes include goods and services tax (GST)

4.5 If there are any imperfections or damage or manufacturing errors that occur in the product it is the customers responsibility to make us aware within 3 business days so that we can rectify the issue.

4.6 variation of colour is expected and is not a defect in the product.

4.7 The inspection of goods is the customers responsibility on arrival of product once goods are accepted or used they are considered received and in good manner.

4.8 Flooring clearance depot cannot be responsible for an act of god, accident, or event resulting from natural causes without human intervention, one that could not have been prevented by reasonable foresight or care. Natural hazards outside human control such as earthquake or tsunami, floods, weather conditions or natural disasters are out of our control, and we will not be held responsible for any damage or delays caused.

4.9 Flooring clearance depot is not a 24-hour service. All phone calls, emails and messages will be answered within business hours.

4.10 No liability or responsibility is accepted by flooring clearance depot for the incorrect colour selection of any product. All colours chosen are outlined in quotes. It is the duty of the customer to ensure all quotes reflect the colour chosen before purchase

4.11 Colours are to be chosen by seeing the products in person as variances can occur in example photographs 

4.12 Characteristics are specific to each manufactured product. Each product is indicative to its own manufactured materials and processes flooring clearance depot cannot be held responsible for these individual processes or materials and processes.


5 onsite policy 

5.1 The team at flooring clearance depot reserve the right to work in a safe workplace. There is a zero tolerance policy for abusive or threatening behavior towards any of our team members, this includes abuse occurring over the phone.

5.2 the team at flooring clearance depot reserves the right to refuse service to anyone who breaches this zero tolerance policy

5.3 if a customer is beaching this policy onsite flooring clearance depot team members have the right to ask you to leave the premises


6 returns 

6.1 clearance based items are not refundable and you will be denied any type of refund for clearance items.

6.2 regularly stocked items may be accepted for a refund however a restocking fee of 25% will be incurred at the customers expense.

6.3 All returns are subject to assessment by the team at Flooring Clearance Depot. Returned items must be in their original condition, unused, unopened, and suitable for resale.

6.4 Upon return, our team will inspect the goods to determine whether they are in acceptable condition. Flooring Clearance Depot reserves the right, at its sole discretion, to refuse a return if the product is damaged, opened, used, altered, incomplete, or shows any signs of wear, handling, or deterioration.

6.5 Goods that are damaged in any capacity, including but not limited to packaging damage, product damage, moisture exposure, or handling marks, will not be accepted for return.

6.6 Approved returns may be subject to a restocking fee. Refunds or credits will only be issued once the returned goods have been inspected and approved by Flooring Clearance Depot.

6.7 Flooring Clearance depot has a strict 30 day return period.

6.8 No returns will be accepted after 30 days under any circumstances.

6.9 All products approved for return must be returned within thirty (30) days from the date of purchase.

6.7 All returns require a receipt, if the customer does not have their receipt no refund or returns will be processed.


7 warranty 

7.1 Manufacturers warranties are solely upheld by the manufacturers and in no way upheld by flooring clearance depot. Flooring clearance depot will only use the manufacturers warranties or recommendations as a guide and can no way agree and disagree with their findings.

7.2 It is the customers responsibility to ensure manufacturers products meet the customers requirements.

7.3 Flooring Clearance Depot does not offer, administer, or extend any warranties beyond those supplied by the manufacturer.

7.4 By proceeding with a purchase, the customer acknowledges that the product warranty meets their requirements.


8. Pricing & Errors

8.1 All advertised prices are subject to change without notice.

8.2 In the event that a product is advertised at an incorrect price or with incorrect information due to typographical error, supplier pricing error, technical malfunction, or administrative oversight, Flooring Clearance Depot reserves the right to: Refuse or cancel any order placed at the incorrect price; and Amend the pricing or product information prior to confirming the order.
8.3 Advertised prices are per square metre unless otherwise stated and do not include installation, delivery, trims, underlay, accessories, or additional materials unless expressly specified.


9.general advertising disclaimer 

9.1 All advertising, promotional materials, product descriptions, images, specifications, and pricing published by Flooring Clearance Depot (including in-store signage, catalogues, brochures, social media, websites, and third-party platforms) are provided in good faith and for general informational purposes only.

9.2 While reasonable care is taken to ensure accuracy, errors and omissions may occur. Flooring Clearance Depot does not warrant that advertising material is free from inaccuracies, typographical errors, or technical errors.

9.3 Advertising does not constitute a binding offer capable of acceptance. A binding contract is formed only upon acceptance of an order and issuance of a tax invoice or written confirmation by Flooring Clearance Depot.

9.4 Advertising displayed on social media platforms, search engines, or third-party websites may not reflect current pricing, stock availability, or promotional terms.

9.5 Flooring Clearance Depot is not responsible for inaccuracies caused by third-party advertising platforms, technical delays, or platform-specific display errors.

9.6 Images depicting installed flooring may include professional installation, styling, lighting, and editing enhancements.

9.7 Final appearance may vary depending on:Subfloor preparation, Installation method, Room dimensions, Lighting conditions and Surrounding décor.


10.Flooring Product Conditions, Installation & Warranty Exclusions
10.1 All timber, hybrid, and laminate flooring products are intended for indoor residential use only and must be professionally installed strictly in accordance with the relevant Installation Instructions and Care & Maintenance Guidelines.
10.2 Flooring is a manufactured or natural product and variations in colour, grain, texture, appearance, and minor movement are normal and not considered defects. Samples, images, and printed materials are indicative only. Colour change over time due to UV light and oxygen exposure is expected.
10.3 warranty does not apply to flooring that is installed in wet areas (including bathrooms, toilets, laundries, saunas, showers, or areas with built-in drains), exposed to excessive moisture, flooding, leaks, spills, appliance failure, uncontrolled heat, or excessive direct sunlight. It also excludes damage caused by improper installation, inadequate expansion gaps, uneven or damp subfloors, building movement, misuse, abuse, heavy furniture, stiletto heels, dragging objects, grit, sand, wheels, chemicals, heat, or industrial products. Any flooring that has been altered, repaired, refinished, or reinstalled is excluded. 
10.4 For timber products, natural characteristics such as colour variation, grain variation, minor splits, checks, or cracks are not defects.
10.5 laminate products are surface water-resistant only (where specified) and do not cover flooding, prolonged water exposure, mould, or mildew.
10.6 Hybrid floors are surface‑waterproof for everyday spills, but not for flooding, built‑in drains, or prolonged water exposure.

10.7 Hybrid flooring must be installed as a floating floor only
10.8 laminate flooring must not be pinned or glued directly to the subfloor.
10.9All suspected defective boards must be identified prior to installation. Installed boards are deemed accepted. Where applicable, defective hybrid boards must be returned before installation.
10.10 If you believe your flooring qualifies for repair or replacement under this warranty or as required by Australian Consumer Law, Flooring Clearance Depot must be notified within 30 days of noticing the issue, and proof of purchase will be required. We will then contact the authorised distributor to determine appropriate next steps, which may include an inspection of the installed flooring.
